Violation of 99.025 of the Town of Clayton’s Unified Development Code – Stakes located in the Town’s right of way.

Pursuant to our conversation re: stakes/bollards and obstructions placed within the Town’s right-of-way.

After the first notice was posted we received calls and emails questioning the location of the right of way, and a definition of the type materials to be removed.

To that end, Planning staff has created a diagram to show right of way (included), and define the obstructions which include but are not limited to bollards, wooden post, rocks, fencing materials, and iron stakes.

It was originally requested that all obstructions be removed no later than close of business on April 17, 2017, due to questions and the need for clarification, we will extend the date to April 21, 2017.

Property owners who fail to remove them will incur daily penalties under Section 10.99 of the Town of Clayton’s UDC, which begin at $50.00 a day.

  1. It’s hard to read the tiny print on the diagram of the “right of way ” – is it supposed to be 16″ or 16′ from the edges of the roadway? Makes a big difference!
